The Minutes of the Planning & Transport Committee meeting held on Tuesday 9th December 2025 at 7.00pm at the Institute.

DSJPC: Deeping St James Parish Council have no objections to the development, however, would like to draw enforcement attention to this aspect of the conservation area currently being cleared of several trees of significant size.
This planning application has also been reported to Planning Enforcement.
 
Enforcement update - Application No: S25/1908.
Deeping St James Parish Council drew enforcement attention to the aspect of the conservation area we understood were currently being cleared of several trees of significant size.
We received correspondence from the enforcement office advising that they had been to look at the land behind 18 Bridge Street, with regards to clearance, and they cannot discern a problem.  Follow-up photos have been sent for the enforcement office’s information.
Councillors discussed this response and considered ways to be more pro-active with regards to aiding enforcement with concerns.

74.26 To consider The South Kesteven Draft Design Code Testing and Engagement Phase II
The information below was shared with the Councillors:
 
The South Kesteven Draft Design Code Testing and Engagement Phase II 
 
Monday 17th November 2025 to Friday 2nd January 2026.

We have now entered the testing and feedback stage for the draft version of our Design Code.
 
This stage of the engagement is aimed at people and organisations who will use the Design Code regularly.
 
Testing
We are encouraging potential users of the code to test the draft on appropriate development proposal/s using the Design Code document and our compliance checklist.
 
Feedback – questionnaire and checklist
We have a short questionnaire to complete, and the compliance checklist can also be used to feedback detailed comments.
 
Timescales to Adoption
Following this testing and engagement phase, amendments will be made to the draft Code and Checklist and final draft versions will then be created.
This final draft code will then go through the statutory consultation process in Spring 2026 with the aim of adopting the Code in Summer 2026 as an SPD linked to our existing Local Plan (2020).

Some organisations may feel that they would benefit from an online or in-person meeting to ask questions, discuss issues and/or provide feedback. Please use the contact details below should you wish to set something up.
 
We are not intending to hold workshops in the same way as we did with the first phase of engagement.

Councillors considered this and RECOMMEND to Full Council to seek permission to support work on this document via the Deepings Neighbourhood Plan.
 
75.26 To consider Bourne Parish Neighbourhood Plan Regulation 14 Consultation
The Bourne Neighbourhood Plan consultation was offered to the Councillors to view.  Councillors noted this proposal.
 
76.26 To consider the bus stop and shelters for Spalding Road, Horsegate.
Email documents were circulated considering the number of now mis-placed bus shelters situated in Deeping St James.  After correspondence with both the local bus service provider and also LCC, Councillors propose to relocate the bus stop currently situated on the south side of Spalding Road, opposite no 61 Spalding Road, to opposite no.4 Braeburn, on the south side of Spalding Road.  A further new shelter has been proposed for the north side of Spalding Road opposite no 44 Spalding Road.  Councillors would like to remind LCC (as the authority leading and taking on the cost of the new shelters), to approach the Welland and Deeping Internal Drainage Board for permissions.
This proposal is to be RECOMMENDED to Full Council to support, and LCC be advised to take these improvements forward.
 
77.26 To consider removing or retaining four redundant bus shelters.
Councillors reflected on retaining or removing four obsolete bus shelters from old bus routes and their potential uses.  Consideration that there may be further development in the future for Deeping St James and the bus route could be reinstated was considered, furthermore, these stops are used as resting places for residents.  
It was RECOMMENDED to Full Council to propose that the bus shelters situated opposite 99 Spalding Road and at the north end of Broadgate Lane were removed, the latter due to it being fractured and the bin at this location to be installed at the new bus shelter site opposite 4 Braeburn.
Councillors requested that plaques were made to advise that the redundant shelters were obsolete, but residents were welcome to use them as rest stops.  Wording is to be agreed.
 
78.26 To receive an update from The Deepings Neighbourhood Plan.

We request that the case officer checks the relationship between plots 3 and 4 in the current application and planning application S25/1128. 
Please ensure Highways check the safety/width of this unusual access and steep gradient that will affect safety upon entering and exiting the property.

The appeal is made under section 78 of the Town and Country Planning Act 1990 (as amended) against a refusal to grant planning permission.
The appeal is made by Ms Shelby Culff against the decision of South Kesteven District Council.
The application Ref is S25/0669.
The development proposed is the removal of a small picket fence and the erection of a new fence closer to the boundary line of the property.
Planning Inspectorate Decision: The appeal is allowed.
DSJPC: Deeping St James Parish Council objected to this planning application due to the obtrusive height of the fence proposed which is considered detrimental to the open characters of the area, given its height (1.83m) and its position forward of the house. Furthermore, there will be hazards caused to the driveway of the adjacent house accessing and exiting the highway

Applicant: Mr Crapper
Proposal: Change of use form agricultural land to open storage (Use Class B8)
Location: Land South of Towngate East Deeping St James
SKDC: Permission has been refused.
DSJPC: Deeping St James Parish Council objected to this planning application for the following reasons:
1. It is contrary to rural planning policies. The site is open land in the countryside and is contrary to policies to prevent such development. It will result in the loss of productive farmland in active use.
2. Gateway into the Deepings. The development will be harmful to Neighbourhood Plan Policy DNP 10: Protecting and Enhancing Important Gateways as it will result in a hard commercial edge to Towngate East without any landscape or other designs to create a visually attractive frontage.
3. Ecology assessment is unconvincing. The BNG assessment appears to have been completed by the applicant who has not offered any professional credentials. It is therefore of low credibility particularly given unfarmed perimeters, some with established hedges. Further, the assessment concludes that habitat units should be created on-site and no details have been provided to show how this will be done.
4. Access. The vehicular entrance to the site will be from Towngate East. As no designs have been done the highway and drainage implications of access onto a fast road, crossing an important drain, cannot be assessed.
5. Enclosures. No details have been provided of (a) fencing enclosures, (b) associated landscape work necessary given its countryside setting, nor (c) how continued access to the public right of way will be maintained.
6. Pylons. These will constrain the development and measures to protect or relocate will be necessary.
