PTC July 2024 Minutes

The Minutes of the Planning & Transport Committee meeting held on Tuesday 9 July 2024 at 7.00pm at the Institute. 
 
Present: Councillors Gilbert, Rose, Shinkins-Hoppe, Smith, Stevens and Dilks. 
 
The Minutes were taken by the Assistant Clerk Louise Brown.
 
13.25 To receive apologies of absence.
Apologies were received and accepted from Cllr Bowell.  Cllr Denman has resigned from the Council.
 
14.25 To receive declarations of interest, if any.
Declarations were given by Cllr Smith and Cllr Gilbert for agenda item 18.25 planning application S24/1029.
 
15.25 To agree the Minutes of the previous meeting held on 11 June 2024.
The Minutes were agreed a true representative and signed.
 
16.25 To receive reports from the Clerk.

Response to 2 Eastgate query.  SKDC ENF23/2015
Location: 2 Eastgate, Deeping St James, Lincolnshire, PE6 8HJ,
Alleged Breach: Roof works to a listed building outside of planning timescales (S15/0974)
 
Received 9th October 2023
I refer to the above matter and your enquiry, dated 6th October 2023.
A site visit was carried out to the development on the 9th October 2023. The works that are occurring are being completed in accordance with application S15/0974. We are currently gathering evidence that the works commenced within 3 years of the decision of application S15/0974, in regards to condition 1 of said application.
I have also advised that further details were required to be submitted as part of the decision regarding joinery details and made the owner aware of this.
Whilst the Council tries to resolve enquiries as quickly as possible, some investigations and resulting actions can become complex and may take some time to resolve. I will write to you again once the case is resolved, a planning application is submitted, or an Enforcement Notice is served.
 
Update dated 5th June 2024
I refer to the above matter and your enquiry, dated 6th October 2023.
Following the discharge of condition 2 of application S15/0974, through the submission of application S24/0904, I can confirm that there does not appear to be a breach of planning control on the Land and I will be closing my case.
We were satisfied that commencement originally occurred within the timescales of S15/0974, however the required submission of details for the doors and windows had not been completed at the time.
Now that these details have been approved no further action is required at this time.
 
Councillor Shinkins-Hoppe queried why enforcement was involved in this case and was advised that it was just a check.  Councillors agreed that the work done is much better than the state of disrepair that the boathouse was previously in.
 
Full Council resolutions
Meridian Solar Farm
Deeping St James Parish Councillors viewed the documents shared by the Planning Inspectorate and considered that they would like to raise serious concerns that the scoping report does not cover. Councillors believe that there is a high priority to preserve high valuable arable land and our food security.
Councillors wished to check that the response had been sent to Meridian and the clerk confirmed that it had.
 
Road naming proposal
Councillors query the choice offered of Jay Dix, due to the potential for mis-spelling and scope for inappropriate corruption.
Previously Councillors have suggested naming roads with relevance to landmarks (to aid first aid response), or after local influential people.  It was suggested that Hibbett Drive may be a choice in keeping with the area, as Harold Hibbett owned the butchers previously on this site.
 
17.25 To receive an update regarding the Deepings Neighbourhood Plan.
Town Centre retail site (next to Poundstretcher).  Negotiations between the developer and co-op are we are told continuing.
 
Previous Landis Gyr Site at Lysander Avenue.  Glass Systems have taken over the large empty premises at Northfields Industrial Estate and this is good news that the space is now being used.
 
The Deepings Housing Needs Survey (first draft), is ready for viewing.
 
Electric vehicle charging.  Councillors considered a planning application that wished to charge their electric car with the cables crossing a pavement, which caused some concern regarding health and safety for the public.  After some investigation, it was discovered that LCC will allow cross pavement charging providing appropriate protective matting is used.
 
Green Walk Wayfinding.  South Kesteven grant funding team are looking to provide money towards the signposts and benches.  The Neighbourhood Plan Team are just awaiting confirmation.
 
SUSTRANS a charity working with communities to create a cycling, walking and wheeling infrastructure strategy have begun their work and we will hear more later in the year.
 
Design Codes
Cllr Smith presented two documents, both are draft and subject to more work and consultation. 
The first document ‘The Deepings Neighbourhood Area Design Guidelines and Codes’, is large with 108 pages.  It contains key diagrams and new guidelines for the design code.  It is 60% completed.  From page 44 onwards, it explains the design codes and has a checklist at the end.
Councillors requested that the title The Deepings is clarified to ensure it refers to Market Deeping and Deeping St James only.  It was suggested that this document be shared with the Assistant Director of Planning at South Kesteven District Council.  The Neighbourhood Plan Team are in continuing communication with SKDC.
 
The second document ‘The Deepings Neighbourhood Plan Community Masterplan’, is based on the 680-site due to be developed in the future at the space at the end of Linchfield Road. The document will help the community directly influence new development when applications for the land are put forward.

Councillors considered that this application is retrospective as signage is already up.  Councillors have no objections, however, would like to highlight the address is incorrect and therefore signage on the door stating ‘welcome to Market Deeping’, is wrong as they are in Deeping St James.
RECOMMEND to Full Council no objections, but to comment on locality.

Councillors would like to comment that they are very concerned regarding the absence of native trees in the landscaping plan and the absence of the ecology report.

Proposal: Submission of details in relation to Condition 3 (Archaeological Watching Brief Report and Historic Investigation and Building Recording) of planning application S20/1862 (Demolition of existing modern farm buildings, alterations and extensions to traditional farm buildings to form two dwellings and erection of five dwellings and associated garages).

Cllrs Smith and Gilbert did not participate in this planning application due to a pecuniary interest declared.
This is a discharge of conditions, which has been previously considered at earlier committees.  Their submission was noted.

Chair’s comment: The officers’ report addressed our concerns about cable crossing the footpath as follows: 
“Some concerns were raised by the Parish Council regarding the potential trip hazard of cables crossing the pavement. Correspondence with the applicant confirmed they will be using a cable floor protector, as advised by LCC Highways, which consists of a non-slip material, with contrasting colour markings in yellow, when using the EV charging point. This is considered to be sufficient to mitigate any potential trip hazard.”
