The Minutes of the Planning & Transport Committee meeting held on Tuesday 16th January 2023 at 7.00pm at the Institute. 
 
Present: Councillors Dilks, Rose, Shinkins-Hoppe, Smith and Stevens. 
The Minutes were taken by the Assistant Clerk Louise Brown.
 
92.24 To receive apologies of absence.
Apologies were received and accepted from Cllr Bowell.  Cllr Stevens did not attend.
 
93.24 To receive declarations of interest, if any.
No declarations were offered.
 
94.24 To agree the Minutes of the previous meeting held on 16 January 2024.
The Assistant Clerk advised that planning application S23/2016, previously listed in section 89.24, had been removed due to the application being sent by SKDC in error being a preliminary enquiry and should not have been received or discussed by the Parish Council.  
The Minutes were then agreed as a true representative and signed.
 
95.24 To receive reports from the Clerk. 
Planning Reference Number: PL/0083/23
Development: For a 1.97 HA south-eastern extension to the existing sand and gravel extraction operations with restoration to amenity/nature conservation

Response by DSJPC sent 19/01/2024.  
Deeping St James Parish Council would like to reiterate the objection comments supplied by West Deeping Parish Council on 26/12/2023.

It was advised that the outcome of the above planning application was that it had received planning consent from LCC and SKDC.
 
Planning Applications taken to FC
S23/2016 – removed due to application being a preliminary enquiry and was not to be discussed.  Sent by SKDC to PC in error.
S23/2370 & S23/2371 – Deeping St James Parish Council has no objections to these planning applications, but would like to request the 6 conditions from S20/1863 be upheld and an update to the Ecology Survey previously performed in 2019 by Inspired Ecology Limited (IEL) be provided.
 
Office Manager at Growth and Culture SKDC
An email was received from the Office Manager at Growth and Culture from SKDC advising of a new way for consultees to submit their planning comments using the new feature on the website, taking effect from 1 March 2024.  
 
Head of Planning at LCC
An email was received from the Head of Planning at Lincolnshire County Council on 6 February 2024 advising that they intend to change their processes so that if responses from consultees have not been received within the statutory consultation period, it will be presumed they have no comments to make they will no longer chase for responses or allow extensions of response time. This is due to the Planning Guarantee requiring Local Planning Authorities to automatically refund an application fee where:
(i) an application has not been determined within the relevant statutory time period and an extension of time to determine the application has not been agreed; and
(ii) (a) Major development - the application remains undetermined 26 weeks from the date the application was validated; or
(b) Minor development – the application remains undetermined 16 weeks from the date the application was validated.
 
Lincs Police and Crime Commissioner
An email has been received from the Police and Crime Commissioner requesting attendance of one elected member of the Parish Council and the Parish Clerk to an engagement session via MS Teams regarding Road Safety on 20th February 6pm-7:30pm.  The Parish Clerk has already accepted the spaces as they are limited.
 
This online meeting will provide a briefing from the Lincolnshire Road Safety Partnership, Lincolnshire Police, a summary of the East of England and East Midlands Road Safety Summit and future plans. It will also be an opportunity for parishes to pose questions to the Lincolnshire Road Safety Partnership, Lincolnshire Police and to the Police and Crime Commissioner.
 
Spaces for this will be very limited so the invitation can only be extended to one elected member and the Clerk of each Parish.  Parish Councillors are welcome to get together with colleagues to share a screen. As much information as possible will be shared after, for circulation to fellow members.
 
96.24 Deepings Neighbourhood Plan.
Town Centre Retail Development.  
Councillor Smith advised that New River Retail development has received planning permission , but there has been a delay in advancing the project as a key person at New River Retail has been ill.
 
West Deeping Quarry.  
We have received a new planning application/scoping consultation, which has been added to the Full Council agenda for next week.
 
Deeping Design Code.
The Deeping Design Code work is continuing to proceed and is being worked on with consultants Aecom, monitored by the members of the NP Team.  In its current state, it looks good with workable graphics and will lead to clear new guidelines for new development.
 
Deeping Gate Housing Development.
Discussion followed regarding possible land development at Deeping Gate and the impact on The Deepings.
 
Hards Lane, Frognall.
Hards Lane has a planning application site, which is currently being investigated as an archaeological site.  No planning permission has been granted as yet.  Across the road, planning permission was refused due to the area being classed as countryside.  It was noted that the matter would be addressed in the ongoing Neighbourhood Plan review.
 
97.24 To consider options for change to include more or less delegation to this Committee, when standing orders are next reviewed.
Cllr Smith has asked if a review of the Standing Orders could be considered, to extend the range of delegated powers over planning and prevent duplication at Full Council.  Discussion ensued as to how this could be managed and still involve the Full Council members when needed.  Cllr Smith is to put ideas together before the next Planning and Transport meeting and circulate them, so that ideas can be considered at a future FP & P meeting.
 
98.24 To consider the Traffic Survey along Horsegate/Spalding Road
An Archer Survey was taken by Lincolnshire Road Safety Partnership along the B1525 Spalding Road between Horsegate and Darbyshire Close, near Frognall.  Councillors discussed the statistics and information provided.  It was reported by the LRSP, that whilst there was some speeding, the collision data shows that the criteria for a fixed or mobile speed camera enforcement is not met.

Councillors discussed that Deeping St James Parish Council should object due to the garage standing forward of the building line thereby adversely affecting the street scene.  Councillors would also like to question the accuracy of the red line noting the boundary line as this could impact development at the property.

RECOMMENDED to bring to Full Council Deeping St James Parish Council have no objections to T1 being pollarded, but strongly request that a bird and bat survey is completed due to the high bat roost potential.
A further comment with regards to T2; Deeping St James Parish Council recognise the need for radical works but given the high amenity value of this tree (bring high profile on the river bank, centred on Hereward Way), would like the Council’s arborist to carefully check the assertion of the applicant that removal is the only option.

DSJPC: Supported with request for conditions.
Chairs Note:  We supported this case as the area has a shortage of storage areas plus the site is close to an industrial area. For these reasons we supported despite the site being in open countryside. SKDC agreed that the site would not be visible, but in approving the case applied normal policies to prevent unsuitable development in the countryside. Cllr Smith states he  will raise the issue of the need for more industrial land with the Deepings Neighbourhood Plan Group as an issue for the DNP Review.

Chairs note. You are recommended to read the delegated decision report on this for the full reasoning for this approval .  We objected given its appearance and impact on the Grade 1 Church and Conservation Area. Amended plans by reduced the front porch from two storey to single and trees were added to the south of the property. Our  views were not fully accepted by SKDC.
