PTC December 2023 DRAFT Minutes

The Minutes of the Planning & Transport Committee meeting held on Tuesday 12th December 2023 at 7.00pm at the Institute. 
 
Present: Councillors Gilbert, Rose, Shinkins-Hoppe, Smith and Stevens. 
The Minutes were taken by the Assistant Clerk Louise Brown.
 
73.24 To receive apologies of absence.
Apologies were received and accepted from Cllrs Bowell and Denman.
 
74.24 To receive declarations of interest, if any.
Cllr Smith declared an interest in agenda item 80.24 – Planning Application no. S23/2157.
 
75.24 To agree the Minutes of the previous meeting held on 14th November 2023.
The Minutes were agreed as a true representative and signed.
 
76.24 To receive reports from the Clerk.
Paperwork was circulated before the meeting advising: 
Ecology Information from Cllr Denman sent to Lincolnshire County Council by the Asst Clerk regarding Baston Gravel Extraction Site. 
1. Most of the ecological surveys were concluded in spring 2022. So, by the time the work starts the reports will be around 2 years out of date. This is in breach of guidelines on the age of ecological reports as published by the Chartered Institute of Ecology and Environmental Management (CIEEM). The surveys should be repeated before planning permission is determined.
2. Section 10.4.47 states there are no rare birds on the site. The breeding bird survey does not mention the European Crane which bred on land near to the site in 2023. As there are only approximately 160 cranes in the UK the breeding bird survey should be repeated in 2024 before planning permission is determined. 
3. Section 10.4.35 provides bat roost information. No indication is provided as to how the trees with bat roost potential were checked and does not state clearly that there are no confirmed bat roosts on the site. In addition, National bat guidance has been revised in September 2023 (CIEEM 2023) and the bat assessment needs to be revised.
4. 13 trees were identified as having medium to high bat roost potential but only 11 were surveyed. No explanation was given why all 13 were not surveyed. As all protected species are a material consideration, the application should not be determined until this is clarified. Bat roost surveys are usually undertaken after May.
 
Brewton Drive/Streton Gardens Play Park and Attenuation Pond.
Enforcement correspondence: ENF23/2038.

Alleged Breach: Play Park and Attenuation Pond not in accordance with approved plans
To whom it may concern,
I refer to the above matter and your enquiry, dated 30th October 2023.
I have been in contact with the developer, and I can provide the following update in relation to this enquiry:
• Landscaping of the POS, fencing to LEAP and pond – 21.11.23.
• Pond – grills to be installed – by 24.11.23.
• Pond mattress baskets – waiting drier weather.
• Cycle path to be completed once the fencing is installed. As you will have seen a section of the cycle path (along the hammer head of Royal Gardens) is fenced off and being used as material storage for the road remedials currently being completed. We are hoping the cycle path and surrounding POS can be completed early December.
I will be making a site visit at the end of November to check the progress is in-line with the above timescales and address any concerns there may be, if required.
 
Councillor Shinkins-Hoppe updated the Planning Committee that RoSPA had been and inspected and some concerns held by the Parish Council had been allowed.  The site is still a work in progress; however, the future maintenance of the site will fall to a Management Company and not the Parish Council.
 
77.24 Deepings Neighbourhood Plan.
An appendix reflecting what was learned from the residents of Deeping St James and Market Deeping was provided with reference to the Neighbourhood Plan from the Christmas Market held on Sunday 3rd December 2023.  Furthermore, display boards used in the Christmas Market were placed in the meeting room, detailing the beginnings of the Design Code, this shows the creation of a procedure when planning a site and was assisted by AECOM.  The displays represented the combined parishes of Deeping St James and Market Deeping.  Copies of this display and further information can be obtained by Cllr Smith.
 
78.24 To receive an update regarding the Peterborough Local Plan.
An update from the Peterborough Local Plan was shared and Councillors looked at the link:https://peterborough.maps.arcgis.com/apps/webappviewer/index.html?id=f6076715bd1c47c19fa79a1f2b9fdb19, which demonstrated areas in Cambridgeshire which are highlighted as sites for potential development.  It indicates the type of site it is and number of dwellings/commercial sites it could provide.
 
79.24 To consider Councillors volunteering to complete the evaluation of the local potential ancient trees for entering onto the Ancient Tree Inventory website.
Councillors were advised that a working party needs to be created to include volunteers able to scour Deeping St James and log trees of significance according to The Woodland Trust requirements.  This could be added to Deepings Naturewatch Facebook page for help.  
Cllr Smith suggested that the trees could be mapped on Parish Online and also a database kept for future use.
Cllr Stevens added that it would be useful to provide a record of the hedgerows in the community also.  This is to be considered at a later time.
The topic was RECOMMENDED to FULL COUNCIL for their information and volunteers.

Proposal: Partial demolition of existing dwelling, including existing roof, erection of

This is a revised proposal for a case considered at our 17 October 2023 meeting.  On this occasion councillors were unable to compare the previous planning application to the new, as the old files were not available on the SKDC planning portal.  Councillors looked at the current application and agreed to use the previous response to SKDC, listed below.
 
The proposal was objected to, due to giving harm to :
• views and the setting of listed buildings to the rear
• the street scene as the extensions were out of keeping 
• neighbour amenity given noise from the new access to the garage running the length of the garden .
